This Privacy Policy explains how Droite Brothers Private Limited ("Droite Brothers", "Avolay", "we", "us", "our"), the company behind the Avolay brand, collects, uses, discloses, and protects the personal data of visitors to and customers of avolay.com (the "Site") and our related sales channels.

By using the Site or placing an order with us, you agree to the collection and use of information as described in this Policy. If you do not agree, please do not use the Site.

2. Personal data we collect

Depending on how you use the Site, we may collect:

  • Contact and account details — name, email address, phone number, delivery and billing address, and (for B2B/wholesale accounts) business name and GSTIN, collected when you create an account, check out as a guest, or contact us.
  • Order and transaction information — products purchased, order value, order history, and payment status (we do not store your full card, UPI, or net-banking details — these are processed directly by our payment partner, see Section 5).
  • Communications — messages you send us by email, phone, or through the Site (e.g. support queries, B2B enquiries), and our replies.
  • Technical data — IP address, browser type, device information, pages visited, and approximate location, collected automatically through cookies and similar technologies when you browse the Site (see Section 6).
  • Marketing preferences — whether you have opted in to receive promotional emails, WhatsApp messages, or SMS from us, and your engagement with those messages.

We do not knowingly collect any special category of personal data (such as health, religious, or biometric information) through the Site.

3. How we use your personal data

We use personal data to:

  1. create and manage your account and process guest checkouts;
  2. process, pack, and ship your orders, and keep you updated on order status;
  3. process payments and refunds;
  4. respond to enquiries, complaints, and customer support requests;
  5. send transactional communications (order confirmations, shipping updates, OTPs);
  6. with your consent, send marketing communications about new products, offers, and restocks, which you may opt out of at any time;
  7. detect and prevent fraud, abuse, and security incidents;
  8. comply with our legal obligations, including under tax, consumer protection, and food-safety law; and
  9. improve the Site's performance and user experience.

4. Legal basis for processing

Where applicable law requires a legal basis, we rely on: your consent (for marketing and non-essential cookies); the necessity of processing to perform your order/contract with us; and our legitimate interests in operating and securing the Site, which are not overridden by your rights.

5. Who we share your data with

We share personal data only as needed to run the Site and fulfil your order, with service providers who are contractually required to protect it, including:

  • Payment processing — Razorpay, to process card, UPI, net-banking, wallet, and Cash on Delivery order confirmations.
  • Shipping and logistics — ShipRocket and its courier partners, to fulfil, dispatch, and track your delivery (domestic and international).
  • Transactional email — our email delivery provider, to send order confirmations, OTPs, and account notifications.
  • Cloud hosting and data storage — our hosting and database providers, to securely store and operate the Site.
  • Professional advisers and authorities — where necessary to comply with law, enforce our Terms of Service, or protect our rights, or in connection with a business transfer (e.g. merger, financing, or acquisition of Droite Brothers Private Limited).

We do not sell your personal data to third parties.

6. Cookies and similar technologies

The Site uses cookies and similar technologies to:

  • keep you logged in and remember your cart (essential, cannot be disabled without affecting Site function);
  • understand how visitors use the Site, so we can improve it (analytics); and
  • where enabled, measure the performance of our marketing (marketing/advertising).

You can control non-essential cookies through your browser settings or any cookie banner presented on the Site. Disabling essential cookies may prevent checkout from working correctly.

7. International and domestic shipping data

If you place an order for delivery outside India, we (and our shipping and customs partners) will share the personal and shipment data necessary to complete customs declarations and cross-border delivery, as required by the destination country's law.

8. Data retention

We retain personal data for as long as needed to fulfil the purposes in Section 3, including the period required to meet our accounting, tax, consumer-protection, and food-safety record-keeping obligations, after which it is deleted or anonymised.

9. Your rights

Subject to applicable law (including the Information Technology Act, 2000 and rules made under it, and the Digital Personal Data Protection Act, 2023 once its provisions come into force), you may:

  • ask us what personal data we hold about you and how it is used;
  • ask us to correct inaccurate or incomplete data;
  • ask us to delete your data, subject to our legal retention obligations;
  • withdraw consent to marketing communications at any time (e.g. via the "unsubscribe" link, or by emailing us); and
  • raise a grievance about how we handle your data (see Section 11).

10. Children's data

The Site is not directed at children, and we do not knowingly collect personal data from anyone under 18. If you believe a child has provided us personal data, please contact us so we can delete it.

We will acknowledge complaints within 48 hours and resolve them within one month of receipt, as required by law.

12. Security

We use reasonable technical and organisational measures (including encrypted payment processing through our payment partner and access controls on our systems) to protect your personal data. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

13. Changes to this Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. The "Last updated" date at the top will show when changes were made. Continued use of the Site after an update constitutes acceptance of the revised Policy.
